These Terms and Conditions ("Terms") govern your use of theapexworks.com and the Apex Site Snapshot service operated by Apex Works ("we," "us," or "our"). By using our website or buying a Site Snapshot, you agree to these Terms.

1. Acceptance of Terms

By accessing theapexworks.com or buying an Apex Site Snapshot, you agree to these Terms. If you do not agree, please do not use our website.

2. Description of Service

The Apex Site Snapshot is a one-time website audit for Washington local businesses. The price is $499, paid once. Checkout is handled by Stripe. The report arrives within about 48 hours after payment and includes a 20-minute Zoom walkthrough. We promise the process and the reporting, not rankings. Google and AI tools change too often for anyone to guarantee those.

3. SMS Communications

Apex Works (theapexworks.com) uses text messages to reply to people who contact us about Apex Site Snapshot and related website services for local businesses in Washington. Messages are replies to Site Snapshot inquiries.

To opt in, text SNAPSHOT (or START) to (425) 217-3284. The only way to opt in is to text SNAPSHOT or START to (425) 217-3284. Message frequency varies. Message and data rates may apply.

Reply STOP to cancel. Reply HELP for help. For support, email damon@theapexworks.com. Carriers are not liable for delayed or undelivered messages.

We do not sell, rent, or share mobile phone numbers with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties.

4. Payment Processing

Site Snapshot payments are processed through Stripe. By paying, you also agree to Stripe's Terms of Service. We do not store payment card information on our servers.

Apex Works shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website or the Site Snapshot. Our total liability shall not exceed the amount you paid us for the Site Snapshot.

8. Modifications

We reserve the right to modify these Terms at any time. Continued use of the website after changes constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
